Senior Legal Counsel (Technology & Financial Services Litigation)
  • Providing guidance to technology teams and business leaders on the privacy, confidentiality, legal and other risks associated with development, operation and implementation of technology systems and innovations, and supporting the development of practical solutions to manage those risks
  • Advising on evolving regulatory requirements and expectations in connection with a range of privacy, cyber, fraud and data issues, including breach notice requirements, ransomware, artificial intelligence cyber resiliency, data retention, critical infrastructure, data risk management, and third-party risk, and developing forward-thinking, practical approaches to privacy compliance
  • Managing and advising on data breach incidents and cybersecurity, including handling of privacy inquiries and investigations by privacy commissioners or securities regulators and self-regulatory organizations (CSA and IIROC)
  • Negotiating and drafting privacy and security terms in commercial agreements and terms of use, conducting privacy impact assessments and supporting other vendor risk management activities from a privacy and technology perspective
  • Overseeing and providing advice on privacy-related functions, including ongoing enhancement of privacy-related policies and procedures, privacy complaints, third party requests for information and access to information requests, employee privacy training and reporting on privacy metrics
  • Managing civil disputes and regulatory matters relating to the wealth management business, including in relation to investor loss claims, registrant conduct and discipline, restrictive covenants and competitive departures, securities regulatory enforcement matters, and investigations (CSA, IIROC and OBSI)
  • Advising on other matters as required
  • Degree in law (LL.B. or JD)
  • Called to the bar of Canadian jurisdiction, and qualified to practice law in Ontario
The Senior Legal Counsel is a key resource in a small, collegial Legal Department supporting one of Canada’s largest, premium independent wealth management firms. This position requires practicing primarily in the areas of technology, data protection, privacy, and litigation management. This position is the primary legal resource supporting the Chief Privacy Officer and key stakeholders in the IT and Operations Departments, while also managing and advising on civil disputes, investigations and securities regulatory enforcement action relating to the broader business of the organization.
